02General Provisions

1. Through SmartPay, the User makes a payment to the Operator, and the PSP accepts the payment and transfers it to the Operator.
2. These Rules constitute an agreement for the provision of a single payment transaction service. Making a payment confirms acceptance of the Rules.
3. SmartPay services can be used without registration, but registration provides additional features.
4. SmartPay executes payment orders immediately, with a maximum term of 24 hours.
5. All transactions are carried out in Moldovan lei (MDL). When using a card in another currency, conversion is performed at the PSP's exchange rate.
6. The maximum single payment amount is up to 50,000 lei.

03Payment Order

1. To make a payment: select the Operator, enter the Client Identifier, amount, confirm agreement with the Rules, choose a payment instrument, verify the data, and authorize.
2. The payment order contains: Operator, Client Identifier, amount, commission (if applicable), total amount, and date.
3. After payment confirmation, changes and withdrawal are not possible, except in cases of Operator refusal.
4. Electronic messages are equivalent to written documents.
5. The amount in the Operator's system depends on the Operator's terms.
6. After payment, an electronic receipt is provided for download or sending to email.
7. In case of a technical failure, the PSP will resend the data.

04User Personal Account

1. Registration of a personal account provides additional features.
2. Registration does not constitute opening a payment account.
3. During registration you must provide an email and create a password.
4. You can also use Google Authentication.
5. By registering, the user confirms that they have read the Rules and the Privacy Policy.
6. The personal account supports tokenization - saving a card token to simplify payments.
7. The user can save a card token by checking 'Save Card' during payment.
8. The saved token can be used for future payments.
9. To pay with a token: log in, select the service, payment method, enter CVV and OTP code.

05Obligations of the Parties

User's Obligations

• Ensure the security of account access data;
• Comply with the payment procedure;
• Comply with the legislation of the Republic of Moldova.

PSP's Obligations

• Transfer the payment amount to the Operator;
• Inform the Operator about the payment;
• Comply with the legislation of the Republic of Moldova.

06Liability of the Parties

1. The parties are liable in accordance with the legislation of the Republic of Moldova.
2. PSP is released from liability in case of force majeure, incorrect information from the user, violation of rules by the user, or unauthorized payments due to data compromise through the user's fault.
3. Losses from erroneous user actions are compensated by the user.
4. If the Client cannot be identified, the amount is subject to refund.
5. If the Client Identifier is incorrect, the user contacts the Operator.
6. The user is responsible for payments made through the personal account.

07Confidentiality

1. PSP maintains the confidentiality of user information.
2. Email is used for sending receipts and notifications, phone for additional features, identifiers for payment processing.
3. Payment information is confidential.
4. By accepting the Rules, the user agrees to the processing of personal data.

08Final Provisions

1. The Rules are effective from the moment of the first payment until full fulfillment of obligations.
2. Relations not regulated by the Rules are governed by the legislation of the Republic of Moldova.
3. PSP may change the Rules and tariffs by publishing the changes on the website.

5. Disputes are resolved through negotiations, and if impossible, in the courts of the Republic of Moldova.
